Dear Associate,

Would you think it strange if someone took the Multistate Bar Exam 20 times? In a recent suit against Multistate Legal Studies, a test prep company, it was discovered that one of the company’s founders had taken the MBE more than 20 times.

Why would anyone want to take the MBE more than 20 times?
A) He is a slow learner.
B) He wants to fully understand the material to be a better trainer.
C) He's there to copy questions and use those same questions as training materials.

Sadly the correct answer is “C.” The National Conference of Bar Examiners recently received a court ruling concluding that MLSI was indeed illegally copying items and ordered them to pay more than $11.9 million in damages. See the first article below.

Related to the story above, Caveon General Counsel, Bob Hunt will be presenting: New Developments in the War on Test Theft. The webinar will examine two recent efforts by test publishers to punish test theft including the legal process and standards used to take-on “braindump” websites and sophisticated “harvesters” of protected test content.
